Privacy policy
How Prime Performing collects, uses, stores and discloses personal and health information.

Who this covers
Prime Performing is a sole trader based in Banora Point, New South Wales, Australia. In this policy “we” and “us” mean Prime Performing, and “you” means anyone who contacts us, uses our services, or has a parent or guardian who does so on their behalf.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Health information is sensitive information under that Act and is collected only with your consent.

What we collect
- Identity and contact details name, date of birth, email, phone, address, and an emergency contact
- Health screening information your answers to the pre-exercise health screening, injuries, medical conditions, medications, and any clearance provided by a health practitioner
- Training and monitoring data test results, training loads, session ratings, wellbeing responses, heart-rate variability and jump measurements
- Video of test efforts short clips of a jump test, where that method is used
- Enquiry details whatever you choose to tell us when you contact us
We collect this directly from you, or from a parent or guardian where the athlete is under 18. Where you ask us to, we may also receive information from your treating health practitioner.

Why we collect it
To deliver the services safely and to do the job you are paying for: screening you before testing, measuring performance, writing and adjusting your training, monitoring load and recovery, producing your reports, communicating with you, invoicing, and meeting legal and insurance obligations.
We do not sell your information. We do not share it with third parties for marketing, and we do not use it to market anything to you other than the services you have asked about.

How it is stored
Your information is held in secure cloud services with two-factor authentication enabled on the accounts that can reach it. Access is limited to those delivering your service.
These services store data on servers that may be located outside Australia. By providing your information you consent to it being stored overseas on that basis, and we take reasonable steps to use providers that handle it in a way consistent with the Australian Privacy Principles.
Video of a test effort is used only to measure the result, and is deleted once that measurement has been recorded.

Daily monitoring, apps and your dashboard
If you take part in daily monitoring, some data is recorded through apps held in your own account — for example heart-rate, heart-rate-variability and jump-measurement apps — and sent to us. Your account with those apps is governed by their own terms and privacy policies, not by this one.
You receive a personal dashboard showing your own monitoring data. It is filtered to you and is not shared with other clients. Where you train with a club or team that has engaged us, the club sees squad-level information; what is shared with the club is set out in the agreement with that club and explained to you before monitoring starts.

When we disclose it
We disclose your information only with your consent — for example sending your report to your physiotherapist or doctor because you asked us to — or where we are required or authorised to do so by law, or where it is necessary to lessen a serious threat to someone’s life, health or safety.

How long we keep it
Health and training records are kept while you are a client and afterwards for as long as we are required to keep them for legal, insurance and professional-practice reasons. For records relating to a person who was under 18 at the time, that period runs from their eighteenth birthday. After that, records are deleted or de-identified.
Where test results are used for comparison or research, they are de-identified first, and nothing identifying you is published without your written permission.

This website
This site does not set tracking cookies and does not run advertising trackers. If you email us, we receive what you wrote and use it only to answer you. Bookings are taken through Square, which handles the payment and holds your booking details under its own privacy terms.

Access, correction and complaints
You can ask for a copy of the personal information we hold about you, ask us to correct anything that is wrong, or withdraw your consent to monitoring at any time. Email [email protected] and we will respond within 30 days. There is no charge for a reasonable request.
If you are not satisfied with how we have handled your information, tell us first and we will try to resolve it. If you are still not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.
